These Terms of Use govern your use of "MyChar: Chat with AI Friends", our mobile application available on the App Store and Google Play, as well as our website at https://www.mychar.io (collectively, the "Services"). By creating an account, downloading the application, or otherwise using the Services, you confirm that you have read, understood, and agreed to these Terms.

TO CANCEL YOUR SUBSCRIPTION, USE YOUR APPLE APP STORE OR GOOGLE PLAY ACCOUNT SETTINGS AT LEAST 24 HOURS BEFORE THE END OF THE FREE TRIAL OR THE CURRENT BILLING PERIOD. IF YOU PURCHASED VIA THE WEBSITE, EMAIL info@mychar.io WITH THE SUBJECT "CANCEL MY SUBSCRIPTION" AND INCLUDE THE EMAIL ADDRESS ON YOUR ACCOUNT.

1. Acceptance of Terms and Parties

These Terms govern the relationship between Boros Studio LLC (the "Company") and you, the user ("you" or "User"). The Terms apply to your use of the Mychar mobile application, website, and other services offered under the Mychar brand.

By accessing or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into binding agreements, and agree to these Terms in full.

2. Important Disclaimer — Nature of the Service

2.1. AI-generated characters and conversations.

Mychar provides AI-generated characters and conversations. The AI Companions are artificial intelligence characters designed to simulate human-like interactions. They do not possess genuine emotions, intentions, consciousness, or the ability to fulfill promises in the physical world.

2.2. Conversations are fictional.

Any elements within conversations that may resemble reality — including but not limited to offers of real-life meetings, promises of tangible outcomes, declarations of love, romantic commitments, or claims of personal experience — are entirely fictional. They are generated by an AI model and should not be taken seriously.

2.3. Not a substitute for professional services.

Mychar is not a healthcare provider, mental health service, psychological counseling service, medical device, or substitute for professional advice of any kind. The Service does not provide therapy, diagnosis, or treatment. If you are experiencing emotional distress, suicidal thoughts, or mental health concerns, please contact a qualified healthcare professional or local emergency services immediately.

2.4. No guarantee of accuracy.

AI-generated content may contain errors, inaccuracies, or content that does not reflect real-world facts. Do not rely on AI Companion responses for medical, legal, financial, or other professional decisions.

3. Account Registration

To use the full Service, you must create an account by providing an email address, device identifier, or social login. You agree to provide accurate registration information and keep it current. You are responsible for all activity under your account.

4. The Service

Mychar offers an AI companion mobile app and web service where users can browse pre-built characters, create custom AI characters, exchange text-based messages, send virtual gifts, view AI-generated images, use voice features, and access additional functionality through subscription or in-app purchases.

Core functionalities are available for free with daily message limits. Subscriptions and in-app purchases unlock extended features. We may modify, suspend, or discontinue any part of the Service at any time.

5. Intellectual Property and User Content

5.1. Our intellectual property.

The Mychar brand, application design, character designs, and all related materials are owned by the Company or licensed to it. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.

5.2. User-generated content.

When you create a custom character, send messages, or submit content ("User Content"), you grant the Company a worldwide, royalty-free, perpetual license to use, store, reproduce, and process such content for the purpose of providing and improving the Service.

5.3. AI model improvement.

Aggregated and anonymized user interactions may be used to improve our AI models and Service.

6. Payments and Subscriptions

6.1. Subscription model.

Subscriptions auto-renew at the end of each billing period unless cancelled. The billing period and price are clearly shown at the time of purchase.

6.2. Cancellation.

You can cancel your subscription through your device settings (Apple/Google) or by contacting support at info@mychar.io.

7. User Representations and Restrictions

7.1. You represent that:

• You are at least 18 years of age
• You will use the Service only for lawful, personal, non-commercial purposes

7.2. You agree not to:

• Use the Service to generate sexual content involving minors
• Use the Service to plan real-world violence or harassment
• Reverse-engineer or scrape data from the Service
• Impersonate the Company or other users

Violations may result in immediate account suspension or termination.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
